There isn’t enough case law to support the Series LLC/DST.
- The Series LLC has been around since 1996. The traditional LLC has been around since 1977 in the United States of America. The same case law applies to LLC’s and Series LLC’s since Series LLC’s are just treated like multiple LLC’s for legal liability purposes. Nobody has been able to strike down the Series LLC as a legal structure, and if they had then you would see the case law reflecting that.
- Are structures are tested with lawsuits almost every month and we’ve never lost a case.
